Clerk who issued same sex marriage licences may face charges

State lawyers filed a brief yesterday against the Montgomery County orphan's court clerk who has issued more than 100 licenses to same sex couples in Pennsylvania.
 
The brief says it is Bruce Hanes's duty to follow state law that defines marriage as between a man and a woman, and county officials who ignore the law "may be guilty of a misdemeanor for each act of neglect or refusal." It also says his decision to issue marriage licenses to same-sex couples "risks causing serious and limitless harm" in Pennsylvania and beyond.
 
Hanes began issuing marriage licenses after Attorney General Kathleen Kane announced she wouldn't defend the state's ban on same-sex marriage in a federal lawsuit.
